Divorce & Family Law News: Grandparents Have Custody; Estranged ...

C.S., 42, of, has filed a petition in a Pennsylvania court asking a judge to restore her visitation rights with the children, who currently are in the custody of their paternal grandparents in Dallas.

Attorney Fred Howe, attorney for C.S. says the children, ages 16, 14 and 12, were transferred to the custody of their grandparents, after their father, former Luzerne County Commissioner Greg Skrepenak, began serving a two-year federal prison sentence on a corruption charge.

C.S. has has a history of substance abuse, and has served prison time for several arrests and probation violations related to those arrests. Her most recent arrest was in Sept. 2010, when she was charged on Sept. 7 with possession of a controlled substance after police found her on the back porch of a city home with an empty packet of heroin. She was released from prison in January and since then has asked the children's grandparents to abide by a 2009 custody order giving her custody on alternating weekends and certain holidays. According to her petition, the grandparents have refusing, claiming the visits would be a detriment to the children.

The petition says the incarcerated Skrepenak, currently serving his sentence in a West Virginia federal prison, supports his estranged wife in her efforts to restore visitation with the children. But attorney Peter Moses, who represented the Skrepenak in his criminal case, said he could not confirm nor deny that as he has not yet spoken to him regarding the custody matter.
